COLORADO DESIGNATED BENEFICIARIES AGREEMENT ACT

 

Overview:  The Colorado Designated Beneficiaries Agreement Act became effective July 1, 2009.  A Designated Beneficiary Agreement is a contract between two unmarried people allowing them to designate one another as the person entitled to certain financial protections and decision-making powers in major life events.  To enter into a Designated Beneficiary Agreement, both parties must be unmarried, at least 18 years of age, competent to enter into a legal contract, and not a party to another designated beneficiary agreement.  The Designated Beneficiary Agreement will continue in effect until one of the designated beneficiaries revokes this agreement by recording a Revocation of Designated Beneficiary Agreement, or upon the marriage of one of the designated beneficiaries.

 

To be legally enforceable signatures on the Designated Beneficiary Agreement must be notarized and the document recorded with the County Clerk and Recorder’s Office in the county where one of the parties resides.  Signature on the Revocation of Designated Beneficiary Agreement must be notarized and the document recorded with the County Clerk and Recorder in the County where the Designated Beneficiary Agreement was recorded.  

 

Beneficiary Agreements and Revocations are open public records.

Fees: 

Designated Beneficiary Agreement: 

            $5.00 per page plus an additional $1.00 surcharge per document (2 pages=$11.00)

            2 certified copies are provided per C.R.S. 15-22-107(3) (b)-$0.25 per page plus $1.00 certification fee

            per document-(2 pages = $1.50 ea. x 2 = $3.00)

            Total for standard 2 page document ($11.00 + $3.00 = $14.00)

If submitting by mail and both parties do not reside at the same address, please include a self-address stamped envelope for return of the 2nd certified copy.

 

Revocation of Beneficiary Agreement:

            $5.00 per page plus an additional $1.00 surcharge per document (1 page = $6.00)

            2 certified copies are provided per C.R.S. 15-22-111(2)-$0.25 per page plus $1.00 certification fee

             per document-(1 page = $1.25 ea. x 2 = $2.50)

            1st class postage for mailing a certified copy to the other party per C.R.S. 15-22-111(2)

            (currently $0.44).

            Total for standard 1 page document ($6.00 + $2.50 + $0.44 = $8.94)

           

Cash, check and money order are accepted.  Check or money order may be made payable to El Paso County Clerk & Recorder.
